Rockland Maine Business License: Victualer $50 to $150, Short-Term Rental Cap of 45 Permits, Cannabis Cap of 6 and Home Occupation Levels

If you searched for a rockland maine business license, the first thing to know is that Rockland does not issue a general one. Maine has no statewide business license, and the city has no general town license either. Rockland licenses by activity through the City Clerk and Code Enforcement, and each activity carries its own fee and rules. This guide covers the licenses most likely to matter to a new business, the current fees, and the caps that limit how many permits the city issues.

This guide covers Rockland, Maine only. It does not apply to Rockland, Massachusetts or to any Rockland in New York.

Informational content, not legal or tax advice. Fees here come from the Rockland fee schedule amended 04/15/2026 and the Land Use fee schedule amended 07/13/2026. Confirm every amount with the named office before you pay, and talk with a qualified attorney or CPA if your ownership or tax situation is complex.

Materials and Information You Need

  • Your legal business name and structure. Sole proprietors and general partners file a sworn assumed-name certificate with the Rockland City Clerk. LLCs and corporations file with the Maine Secretary of State.
  • For an LLC, a filed Certificate of Formation (Form MLLC-6) with a $175 filing fee. For a corporation, Articles of Incorporation (Form MBCA-6) with a $145 filing fee.
  • A registered agent. Every Maine LLC and corporation must maintain one. A noncommercial agent must give a physical street address in Maine, not a P.O. box.
  • For food businesses, a menu, floor plan and equipment list. For food trucks, your State license number, since the city application asks for it.
  • For a short-term rental or home business, the property address and its zoning district.
  • A sales tax permit application if you sell taxable goods or services. The list of taxable services is closed, so confirm your service is on it before you register.

Step 1: Confirm Your Activity Needs a City License

Describe exactly what you plan to do to the City Clerk or Code Enforcement and ask which permits apply. Be specific. A catering operation, a take-out counter and a restaurant with a bar fall under different categories. Then check the state side. Business Answers at maine.gov/businessanswers is a free state tool that identifies state permits and licenses for your activity. Some trades need a board license from the Department of Professional and Financial Regulation. Maine has no HVAC or general contractor license, so ask about your specific trade.

Step 2: Form Your Entity or Register Your Assumed Name

Forming an LLC or corporation is a filing, not a license. Check name availability in the Secretary of State business search. An LLC name must include words such as limited liability company or LLC. To hold a name while you prepare papers, file Form MLLC-1 for $20, which reserves the name for 120 days.

Maine does not accept formation documents online. The forms are fillable PDFs that you print and mail or deliver with payment. The Secretary of State's corporate processing time is listed as 2 to 7 business days, but treat that as variable. Expedited handling is available for an added fee: $50 per request for 24 Hour Service, or $100 per request for Immediate Service, which depends on staffing when you ask.

If you operate under a trade name through an existing LLC or corporation, file Form ASUM-5 with the Secretary of State for $125. Sole proprietors and general partnerships skip the state and file the sworn assumed-name certificate with the City Clerk instead. The city sets that fee, so confirm it with the Clerk.

Step 3: Get the State Licenses That Apply

Several state agencies license activities that Rockland will ask about. The Health Inspection Program within the Department of Health and Human Services licenses eating places. The Department of Agriculture, Conservation and Forestry licenses food processors. The Bureau of Alcoholic Beverages and Lottery Operations issues liquor licenses, and holding a State liquor license changes your Rockland victualer fee, as explained below. Start these applications early. For a mobile food unit, confirm with the Health Inspection Program which license applies and what it costs, because those figures are not part of this guide.

Step 4: Apply for the Rockland Activity License

The Rockland fee schedule, amended 04/15/2026, sets the following city activity fees. Confirm each one with the City Clerk before you pay.

LicenseCity FeeNotes
Victualer, food eaten on premises with a State liquor license$150Highest victualer rate
Victualer, food eaten on premises without a State liquor license$100
Victualer, take-out only$50Lowest victualer rate
Hawker and peddler$75Up to 1 week
Itinerant vendor$75
Amusement devices$125 to $500Set by number of devices
Lodging house$100
Sidewalk tables$25Per table

The victualer fee depends on how you serve food, so pick the category that matches your service model exactly. Food trucks apply to Code Enforcement at least 21 days before opening. The application asks for your State license and a city victualer license, so prepare both in the same window. Ask Code Enforcement whether your truck needs both before you set an opening date.

Step 5: Short-Term Rentals (Sec. 11-210)

Rockland's short-term rental rules sit in Section 11-210 and use three permit categories: STR-1, STR-2 and STR-3. Confirm with Code Enforcement which category fits your unit. The city issues no more than 45 non-owner-occupied permits a year, so ask the Clerk whether capacity is open before you buy a property for this purpose. Permits must be renewed before March 15, and non-owner-occupied units are inspected every 3 years.

Under the Land Use fee schedule amended 07/13/2026, STR-1 costs $250 initially and $175 to renew. STR-2 and STR-3 cost $325 initially and $225 to renew. The Clerk's schedule lists a different $100 short-term rental line. Check with the City Clerk which figure applies before you budget. Lodging is taxed at 9% under Maine sales tax, so price your nightly rate with that in mind.

Step 6: Cannabis Store Licenses (Sec. 11-222)

Section 11-222 caps the city at 6 cannabis store licenses, with no more than 3 in any one zone. Licenses are awarded by lottery, so an application does not guarantee a license. The application fee is $1,000, the retail store license is $1,650, and the lottery carries a $100 fee. Ask the City Clerk about the lottery schedule and how zones are mapped, and check zone eligibility with the Planning office before you sign a lease.

Step 7: Home Occupation Levels

Home occupations are licensed in Levels 1 to 3. A home occupation costs $65, or $330 when it requires Planning Board review. The brief for this guide does not specify which activities fall under each level or which level triggers Planning Board review, so check with Code Enforcement before you apply. Describe client visits, signage, employees and equipment, since those details usually decide the level.

Step 8: Register for Sales Tax and Plan Your Annual Filings

Maine's general sales tax rate is 5.5%. Prepared food and on-premises liquor are taxed at 8%, lodging at 9%, and short-term car rentals at 10%. Apply for a sales tax permit through Maine Revenue Services, and find general tax information at maine.gov/revenue.

Every LLC and corporation must file an annual report for $85, due June 1 each year. The first report is due between January 1 and June 1 of the year after formation. Maine has no LLC franchise tax and no separate LLC annual tax. A default LLC is taxed as a pass-through, so members report income on their Maine individual returns at rates of 5.8% to 7.15%. An LLC that elects corporate treatment pays corporate income tax at 3.5% to 8.93%.

If the business sits on property you own, budget for the local property tax as well. The FY2027 Rockland rate is $17.58 per $1,000 of valuation, at a 100% ratio, with the tax commitment dated August 12, 2026.

Common Mistakes to Avoid

  • Treating a state filing as a city license. Forming an LLC or registering a name is a filing. You still need the Rockland activity license.
  • Assuming a flat victualer fee. Your fee is $150, $100 or $50 depending on whether you serve on premises and whether you hold a State liquor license.
  • Using a P.O. box as a noncommercial registered agent address. The agent needs a physical street address in Maine.
  • Filing a food truck application late. Code Enforcement needs it at least 21 days before opening.
  • Budgeting from the wrong short-term rental fee. Confirm whether the $100 Clerk line or the Land Use schedule applies.
  • Missing renewal dates. Short-term rental permits renew before March 15, and LLC annual reports are due June 1.
  • Skipping the state license. Rockland may ask for it, and some activities cannot open without it.

What to Expect

Timing at the City Clerk and Code Enforcement can shift with workload, and expedited state requests can be delayed when volume is high. Build extra time into any target opening date, and treat every timeline in this guide as an estimate rather than a promise.
