Sanford Maine Business License: Cannabis Retail $22,500 With a Cap of 8, Victualer $75, Peddler $50 and STR Primary-Residence Rule
Sanford Maine Business License: Cannabis Retail $22,500 With a Cap of 8, Victualer $75, Peddler $50 and STR Primary-Residence Rule
Searching for a sanford maine business license? The first thing to know is that Maine does not issue a general one. The state has no general statewide business license, and most towns have no general town license either. Forming an LLC or corporation, or filing an assumed name, is a filing, not a license. In Sanford, licenses are issued by activity under City Code chapter 149, and the fee for each one is set in section 149-1.4. This guide explains how to sort out which approvals apply to you, what each one costs, and where applicants usually run into trouble.
Informational note: This article is general information, not legal or tax advice. If your situation is complex, such as a cannabis application, a short-term rental in a mixed-use property, or a food business that involves building work, talk with a Maine attorney or CPA before you file.
What You Need Before You Start
- Your legal name and a Maine mailing address for yourself and any co-owners
- Your business structure: sole proprietorship, general partnership, LLC or corporation
- The exact street address where the business will operate, plus the zoning district if you know it
- A plain written description of what you will sell or do, since Sanford licenses activities rather than businesses in general
- For an LLC or corporation: a name that meets Maine rules and a registered agent, either a listed commercial agent or a noncommercial agent with a physical Maine street address (not a P.O. box)
- A payment method the filing office accepts, confirmed before you mail anything
- For food service, rentals or building work: a simple site plan drawing and any insurance information the city asks for
Step 1: Form Your Entity or File Your Assumed Name
If you operate under your own legal name, you can skip this step. If you form an entity or use any other name, file with the correct office.
LLC. File a Certificate of Formation (Form MLLC-6) with the Secretary of State under 31 MRSA 1531. The filing fee is $175. The name must include “limited liability company,” “limited company,” “L.L.C.,” “LLC,” “L.C.” or “LC” under 31 MRSA 1508. You can reserve a name for 120 days on Form MLLC-1 for $20. The Secretary of State currently lists 2 to 7 business days for corporate filings, with expedited options at $50 for 24-hour service or $100 for immediate service, depending on staffing at the time of your request.
Corporation. File Articles of Incorporation (Form MBCA-6) under Title 13-C, the Maine Business Corporation Act. The filing fee is $145.
Annual report. LLCs and corporations file an annual report for $85 each year. The first report is due between January 1 and June 1 of the year after formation, and every later report is due June 1. Mark June 1 on your calendar the day you form the entity.
Assumed name. An LLC or corporation files Form ASUM-5 with the Secretary of State for $125. A sole proprietor or general partnership instead files a sworn assumed-name certificate with the clerk of the city where the business operates, under 31 MRSA 1. The state does not publish the municipal fee, so confirm the Sanford amount with the City Clerk.
Forming an LLC or corporation also requires a registered agent. Appointments and changes are filed on Form CLKRA-3 for $35.
Step 2: Identify Your Sanford License Category
Sanford sorts its licenses into two groups. Category 1 (administrative) licenses are issued without a council vote. Category 2 items need City Council approval and take longer. Check the category first, because it determines your timeline and your budget.
| Category 1 license | Fee (per year unless noted) |
|---|---|
| Victualer (Chapter 209) | $75 |
| Peddler (food excluded) | $50 per year or $25 per day |
| Secondhand dealer | $200 |
| Salvage dealer | $500 |
| Pawnbroker | $300 |
| Lodging establishment | $100 per unit |
| Home occupation (Chapter 280) | $50 |
| Taxi business / taxi operator | $60 / $40 |
| Rental housing | $100 for a single-family unit, up to $500 for eight or more units |
| Waste hauler | $500 |
Step 3: Get a Victualer License for Food Service
A victualer license covers food service in Sanford, and the fee is $75 under Chapter 209. A city license does not replace state permits. Maine licenses eating places through the Health Inspection Program in the Department of Health and Human Services, and licenses food processors through the Department of Agriculture, Conservation and Forestry. Which state license applies depends on what you make and how you sell it, so confirm with the right agency before you buy equipment or sign a lease.
Prepared food and on-premises liquor are taxed at 8% in Maine. Register for a sales tax permit with Maine Revenue Services at revenue.maine.gov before you make taxable sales.
Step 4: Decide Whether a Peddler License Fits
A peddler license costs $50 for a year or $25 for a day. Food is excluded, so if you sell food from a cart, truck or stand, you need the victualer route in Step 3 instead. Ask the City Clerk whether your product and your route fall under peddling or under another category before you pay for either license.
Step 5: Check Zoning for Home Businesses and Short-Term Rentals
A home occupation license costs $50 under Chapter 280. The zoning question matters more than the fee. Short-term rentals are governed by section 149-5.18, added June 20, 2023. In the Urban and Single-Family Residential zones, the short-term rental must be the owner’s primary residence. Only one short-term rental is allowed per multiunit property. The owner must carry insurance, and the ordinance sets a two-adults-per-bedroom standard. Read the full section before you list the property, because a property that is otherwise eligible can still fail the primary-residence test.
Step 6: Apply for Cannabis Retail Through Council Approval
Adult-use marijuana retail requires City Council approval and a $22,500 application fee for each application. That is the highest local retail fee in our Maine survey. Sanford caps marijuana property licenses at 8 under section 161-2.3, so check how many are already in use before you commit to a lease. Property licenses cost $5,000 for Tier 1 and $7,500 for Tier 2 buildings of 30,000 square feet or more, plus $750 per licensed facility.
Ask the City Clerk whether each fee is due at application or at approval, and whether the $22,500 application fee is separate from the property license fees. Local approval does not replace any state license the activity requires, so confirm the state requirements with the state agency that regulates cannabis.
Step 7: Confirm Site Plan and Change-of-Use Fees
If you are altering a building or changing its use, check the Planning and Development fee schedule. Site plan and change-of-use fees are not listed in this guide, so do not budget from an estimate. Get the figure from the city before you hire a designer or contractor.
Step 8: Submit, Pay and Track Your Deadlines
Submit each application to the office that administers that license. For most licensing questions this is the City Clerk, and for site plans it is Planning and Development. Confirm the right office first, since submitting to the wrong desk adds time. Keep a copy of every form, receipt and approval. Then calendar your recurring dates: the state annual report on June 1, any city renewal date printed on your license, and your sales tax filing schedule.
Common Mistakes to Avoid
- Looking for a general Maine business license. Maine has none, so do not pay anyone for one.
- Filing an LLC name without a required ending. The name must include “LLC,” “L.L.C.,” “L.C.,” “LC” or the full phrase, or you will pay to correct it.
- Forgetting the $85 annual report. It is due every June 1 after the first report.
- Assuming a short-term rental is allowed because the house is residential. In the Urban and Single-Family Residential zones, it must be your primary residence.
- Treating a peddler license as food permission. Food is excluded from the peddler license.
- Signing a lease before checking the marijuana cap. Only 8 marijuana property licenses are allowed in Sanford.
- Skipping the sales tax permit. Prepared food is taxed at 8%, and you need the permit before you sell.
- Searching the wrong Sanford. Sanford, Florida and Sanford, North Carolina have different codes and fees. Use only Sanford, Maine rules.
Expected Results and Timing
A complete Category 1 application may be processed without a council vote, although actual timing depends on staffing and on how complete your paperwork is. Category 2 items, including cannabis retail, generally follow a council process and may take considerably longer. The Secretary of State’s current 2 to 7 business day figure applies to state corporate filings only, and it can change. Ask the City Clerk for current processing times before you set an opening date.
